Tribunal Hearing Convened 22.12.2007 – Respondents – Brett Harm, Rick Cunning, Andrew (Sid) Whittaker.
The tribunal met 9.30am Saturday 22.12.2007 at Nambour to determine findings arising from an incident in the pits at Kingaroy Speedway on Saturday 8.12.2007
After hearing the evidence, assessing witness statements and questioning persons involved the panel made the following determinations:
Brett Harm:
That Brett Harm be suspended from holding a competition licence or competing for the period 08 December 2007 up to and including 8th June 2008.
Rick Cunning:
That Rick Cunning serve a good behavior period up to and including 30 June 2008. Any cause for the issue of a chief stewards infringement notice under Section 7 of the Australian Racing Rules and Regulations will be considered a breach of this penalty and that he will then automatically be suspended from that time up to and including 30 June 2008, in addition to any further penalty issued through that Chief Stewards infringement notice and/or any further penalty issued by any future Race Control Tribunal for that infringement/breach.
Andrew (Sid) Whittaker:
That Andrew (Sid) Whittaker serve a good behavior period up to and including
8 December 2008. Any cause for the issue of a chief stewards infringement notice under Section 7 of the Australian Racing Rules and Regulations will be considered a breach of this penalty and that he will then automatically be suspended from that time up to and including 08 December 2008, in addition to any further penalty issued through that Chief Stewards infringement notice and/or any further penalty issued by any future Race Control Tribunal for that infringement/breach.
